Pemenuhan Hak Narapidana Anak Di Lembaga Pembinaan Yang Bukan Khusus Anak

Setiap anak memiliki hak untuk tumbuh dan berkembang, hak untuk mendapatkan perlindungan, dan hak untuk berpartisipasi tanpa terkecuali bagi anak yang berkonflik dengan hukum. Anak yang dijatuhi hukuman pidana pada hakekatnya ditempatkan di Lembaga Pembinaan Khusus Anak. Namun saat ini masih banyak narapidana anak yang ditempatkan bersama dengan narapidana dewasa. Penelitian ini bertujuan untuk mengetahui gambaran pemenuhan hak narapidana anak yang ditempatkan di lembaga pembinaan yang bukan khusus anak, secara khusus hak untuk bertumbuh dan berkembang, hak untuk mendapatkan perlindungan, dan hak untuk berpartisipasi. Dalam penelitian ini digunakan pendekatan penelitian kualitatif yang melibatkan 3 orang responden. Hasil wawancara menunjukkan bahwa hak untuk mendapatkan perlindungan tidak terpenuhi secara optimal oleh ketiga responden saat menjalani pembinaan dikarenakan adanya resiko untuk mengalami perundungan oleh narapidana dewasa. Penelitian lebih lanjut dibutuhkan untuk mengetahui solusi dari permasalahan yang muncul pada anak yang ditempatkan di lembaga yang bukan khusus anak baik secara preventif maupun kuratif.
