Hambatan Hukum untuk Penikmatan Hak atas Pekerjaan bagi Pekerja dengan Disabilitas

Artikel ini berfokus pada penikmatan hak atas pekerjaan bagi pekerja dengan disabilitas. Fokus ini dilatarbelakangi oleh fakta perihal perlakuan diskriminatif bagi pekerja dengan disabilitas di tempat kerja. Studi ini mengidentifikasi, misalnya, seorang pekerja dengan disabilitas sensorik dan fisik justru ditempat di bidang kerja yang tidak aksesibel untuk ragam disabilitasnya. Penempatan ini menghadirkan hambatan baginya dan berujung pada pemutusan hubungan kerja terhadap sang pekerja. Berdasarkan kondisi faktual tersebut, artikel ini menjawab dua pertanyaan penelitian. Pertama, apa hambatan hukum dalam penikmatan hak atas pekerjaan bagi pekerja dengan disabilitas? Kedua, intervensi memadai apa yang dapat dilakukan negara guna menjaminan kesetaraan dan perlakuan non-diskriminasi bagi pekerja dengan disabilitas? Studi normatif ini menjawab dua rumusan masalah tersebut dengan cara menganalisis norma Undang-Undang Nomor 13 Tahun 2003 tentang Ketenagakerjaan dengan komponen hambatan hukum dalam model sosial untuk disabilitas. Studi ini membuktikan bahwa ketentuan di dalam UU Ketenagakerjaan masih menjadi hambatan hukum dalam penikmatan hak atas pekerjaan bagi pekerja dengan disabilitas di tempat kerjanya. Maka itu, studi ini mendorong fungsi legislasi negara untuk melengkapi ketentuan UU Ketenagakerjaan, yang substansinya mengatur pemberi kerja untuk memastikan tata kelola bisnisnya inklusif dan aksesibel bagi keragaman pekerja dengan disabilitas berdasarkan kesetaraan hak.
